ELIGIBILITY
The Chocolate Adventure Recipe Contest (“Contest”) is open to legal residents of the 50 United States and District of Columbia who are 18 years of age or older as of October 1, 2008. Employees of TuttiFoodie (Main Sponsor) or Scharffen Berger Chocolate Maker (Affiliate Sponsor) (collectively “Sponsors”), their parents, affiliates, advertising and promotion agencies, printers and judges, and immediate families and individuals residing in the same household with any of these employees, are not eligible to enter or win. Void in Puerto Rico and where prohibited or restricted by law. No purchase is necessary to compete in this contest.

ENTRY PERIOD
The Contest begins at 12:00:01 AM Pacific time on October 1, 2008 and ends 11:59:59 PM Pacific time on January 4, 2009 (“Entry Period”).

HOW TO ENTER
Review the contest rules and access the Official Recipe Submission Form online at www.chocolateadventurecontest.com. All online entries must be submitted with the Official Recipe Submission Form; failure to do so will result in disqualification of entry. Online entries must be received by 11:59:59 PM Pacific time on January 4, 2009. LIMIT TEN ENTRIES PER PERSON AND PER E-MAIL ADDRESS during the Entry Period, regardless of whether more than one person uses the same e-mail address. In case of a dispute as to the identity of a winner who enters, entry will be declared by the registered user (meeting eligibility criteria) of the e-mail account and, if a prize is won, will be awarded to that registered user. The use of robotic, repetitive, automatic, programmed or similar entry methods of agents (including but not limited to, sweepstakes entry services) are prohibited and will void all such entrant’s entries. If you do not have access to the Internet, you may print the Official Recipe Submission Form, fill out, attach your recipe and place in an envelope with sufficient postage; then mail to: Chocolate Adventure Recipe Contest, c/o TuttiFoodie, 1714 Franklin Street #100-280, Oakland California 94612-3409. Mail-in entries must be postmarked by January 4, 2009 and received by January 15, 2009. Limit ten entries per person, per postal address. All mail-in entries must be submitted along with the signed Official Recipe Submission Form; failure to do so will result in disqualification of entry. Illegible or incomplete entries will be disqualified. The Sponsors are not responsible for mutilated, illegible, incomplete, late, misdirected, postage-due, lost or stolen entries. Proof of mailing or submission of any entry will not be considered proof of receipt. Entries will not be returned.

LIMITATIONS OF LIABILITY
Sponsors and their affiliates, subsidiaries, parent companies, advertising and promotion agencies, printers and judges involved in this promotion are not responsible for any inaccuracies in information which may be used in the Contest, for any technical or human error which may occur in the processing of entries, including data entered by entrants, any entry miscommunications such as technical failures related to computer, telephone, cable, and unavailable network or server connections, related technical failures, or other failures related to hardware, software or virus, or incomplete, late or misdirected entries. Any compromise to the fair and proper conduct of this Contest related to a computer virus, or similar type of technical impairment that may affect the proper fairness, security and administration of the Contest may result in the termination, amendment or modification of the Contest, or portion thereof at the sole discretion of Sponsor. Sponsor reserves the right, in its sole discretion, to void any entries of entrants whom Sponsor believes has attempted to tamper with or impair the administration, security, fairness or proper play of this Contest or who acts in a non-sportsman like manner or with the intent to threaten or harass any other person.

RECIPE CONTEST CRITERIA
Each recipe entered must call for Scharffen Berger® Chocolate—either dark chocolate (mentioning exact cacao content anywhere from 62 to 99 percent) or milk chocolate or cocoa—along with at least one “adventure ingredient” from the following list: Popping candy (unflavored or flavored), wattleseed, palm sugar, basil, mustard seeds, coriander, black sesame seeds, black or pink peppercorns, chili pepper (fresh or whole dried), coconut milk, kaffir lime leaf, matcha tea, mango, plantain, jicama, tapioca pearls (any size), tamarind (or tamarind paste), cacao nibs. Entry must include complete directions for preparation, utensils required, mixing, cooking/refrigeration/freezer time, type and size of pans, and number of servings. Each recipe must list exact ingredients in standard U.S. measurements. The Sponsors recommend listing each ingredient in the order of use. In order to be eligible, your recipe must be your own and original and should never have been published before, won any other prize, or been submitted or entered in any other recipe or food preparation contest.
All entries submitted become the exclusive property of the Sponsors and none will be returned. Entrants represent that recipes submitted are his/her original work. By entering, entrants agree to assign all rights including copyrights, to entry to the Sponsors. Entry into this Contest constitutes permission to use recipes, photographs, and the name, photograph and/or likenesses of entrants in any manner in perpetuity and in any media by the Sponsors, their advertising, promotion and/or public relations agencies with no additional compensation, unless prohibited by law.

JUDGING CRITERIA
The Judges will judge recipes in three (3) separate categories as follows: Sweet, Savory, and Beverage. Judging in each category will be conducted in two rounds. The first round will be based on originality, creativity and whether the recipe represents a spirit of adventure (40%), perceived taste of finished recipe (35%) and perceived ease of preparation (25%). Entries will be judged under the supervision of a judging panel whose decisions will be final and binding on all matters relating to this contest. The 15 highest scoring recipes in the first round will be prepared and judged according to the following criteria: originality and creativity and whether the recipe represents a spirit of adventure (35%), taste of finished recipe (30%), ease of preparation (25%) and appearance (10%). Entries will be judged under the supervision of a judging panel whose decisions will be final and binding. Judging will take place on or about February 11, 2009. All judges’ decisions are final.

PRIZES
One (1) Grand Prize winner from the Sweet category will receive $5,000. One (1) Grand Prize winner from the Savory category will receive $5,000. One (1) Grand Prize winner from the Beverage category will receive $5,000. Three (3) Grand Prizes will be awarded in total. Each Grand-Prize winner will also receive the Scharffen Berger® Chocolate Adventure Contest medal, a gold-colored likeness of a Scharffen Berger® 3-ounce bar. Each Grand-Prize winning recipe title, along with the creator’s name, will be announced in Saveur Magazine. The recipes will be featured on TuttiFoodie.com and in the Scharffen Berger e-newsletter. The Grand Prize winners will also receive a signed copy of Demolition Desserts by Elizabeth Falkner, and a signed copy of Pure Dessert by Alice Medrich. And each winner will receive a special custom Scharffen Berger® chocolate collection worth $250. The value of each grand prize is approximately $5460.
One (1) Second Place Prize winner from the Sweet category will receive a special custom Scharffen Berger® chocolate collection worth $250 and a signed copy of The Essence of Chocolate by Robert Steinberg and John Scharffenberger. One (1) Second Place Prize winner from the Savory category will receive a special custom Scharffen Berger® chocolate collection worth $250 and a signed copy of The Essence of Chocolate by Robert Steinberg and John Scharffenberger. One (1) Second Place Prize winner from the Beverage category will receive a special Scharffen Berger® chocolate collection worth $250 and a signed copy of The Essence of Chocolate. Three (3) Second Place Prize winners will be awarded in total. The second-place recipes will also be featured on TuttiFoodie.com and in the Scharffen Berger e-newsletter. The value of each second place prize total is approximately $360.

GENERAL TERMS
If aspects of the Prizes change outside the control of the Sponsors neither the Sponsors nor any other promotional partners furnishing Prize consideration, will be liable or responsible for any such changes and Sponsor reserves the right to substitute a Prize of equivalent or greater value, at Sponsor's sole and absolute discretion, if, for any reason, all or any portion of Prizes, as described herein, are or become unavailable. No transfer of prize to a third party is permitted. No cash substitutions will be offered for prizes. By accepting a Prize, prize winners agree that Sponsor shall not be liable for any injuries, damages or losses of any kind resulting from or in connection with the awarding, acceptance, possession or use of the Prize or any aspects or parts thereof. Prize winners are responsible for paying any necessary State and Federal taxes related to the winnings. If applicable, winner may receive an IRS Form 1099 for the retail value of the prize. Each winner’s first name, last initial, hometown and state will be disclosed on the Winner’s List which will be distributed upon request and as required by law.

NOTIFICATION
Potential prize winners will be selected and notified by email and/or telephone on or about February 20, 2009. If potential prize winner cannot be reached with 3 attempts, does not respond, or an emailed prize notification is returned as undeliverable for any reason, potential prize winner may be disqualified and the next best (runner-up) contestant will be selected as a potential prize winner. All prize winners must sign and return Affidavit of Eligibility & Liability/Publicity Releases (where permitted), and/or Prize Acceptance Form, within ten (10) days of receiving such prize claim paperwork (via mail or overnight courier) as a condition of receiving the prize.

CONDITIONS
By entering the Contest, potential winners agree that Sponsors, judges, their respective parent companies, divisions, affiliates and subsidiaries, and each of their directors, officers, employees, agents, representatives, successors and assigns, and all others associated with the development and execution of this Contest, their officers, directors, subsidiaries or affiliates and their agencies and employees shall not be held liable for any injuries, losses or damages, including death, resulting from participation in this Contest or prize acceptance. All contestants, as a condition of entry into the Contest, agree to release Sponsors, from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, losses of any kind to persons including death or property which may be sustained directly or indirectly with the receipt, ownership, use or misuse of any prize awarded or for any typographical or other error in these Official Rules or with the announcement of or offering of any prize. The winner shall bear all risk of loss or damage to their prize after it has been delivered.

WAIVER
By entering, participant waives all rights to claim punitive, incidental and consequential damages, attorneys' fees or any damages other than actual out-of-pocket costs or losses that may arise in connection with participation in the Contest or acceptance, possession and use of any prize. Where legal, by accepting prize, winner agrees to the use of his/her name, city/state, likeness, photograph and/or voice and statements by winner for advertising/publicity purposes without notice or further compensation. By entering, entrants agree that this Contest is governed by laws of California.

DISPUTE RESOLUTION
Except where prohibited, by participating, you agree that a) any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating, but in no event attorney's fees; and c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplies or otherwise increased.

WINNERS LIST
A list of the prize winners will be visible on or about February 20, 2009 at www.chocolateadventurecontest.com. Any mailed requests to receive the list of prize winners must be sent to TuttiFoodie Inc. at 1714 Franklin Street #100-280, Oakland, California 94612-3409 and must be accompanied by a stamped, self-addressed envelope.
